A 17-year-old in Illinois accused of killing two protesters days after Jacob Blake was shot by police in Kenosha, Wisconsin, on Friday fought his return to Wisconsin to face homicide charges that could put him in prison for life.

Kyle Rittenhouse surrendered to police in his home in Antioch, Illinois, a day after prosecutors say he shot and killed two protesters and wounded a third on the streets of Kenosha on Aug. 25. His attorneys have said Rittenhouse acted in self-defense and have portrayed him as a courageous patriot who was exercising his right to bear arms during unrest over the police shooting of Blake, who is Black.

Rittenhouse attorney John Pierce said during a hearing Friday that he intends to fight extradition. Judge Paul Novak gave the defense 14 days to review papers and file pleadings ahead of an Oct. 9 hearing.

“We intend to challenge extradition by writ of habeas corpus,” Pierce said

He didn’t provide further details at the hearing about the basis for the challenge. The delay in returning Rittenhouse to Wisconsin is the second in the case.

Mike Nerheim, the Lake County state’s attorney, said after the hearing that Illinois Gov. J.B. Pritzker had signed a warrant to return Rittenhouse to Wisconsin after a request was made by Wisconsin Gov. Tony Evers, a fellow Democrat. Rittenhouse’s attorney asked for a chance to review the warrant, which Nerheim said he had received Friday morning.

Nerheim said he didn’t know on what basis Rittenhouse would challenge extradition.

“We’re ready to proceed,” he said.

Rittenhouse attended the hearing via a video feed and did not speak other than to say, “Good morning your honor” to the judge. He wore a blue face mask and a black sweatshirt.

Pierce also requested that he be allowed to bring a laptop into the juvenile detention facility in Vernon Hills where Rittenhouse is being held, despite a ban on electronic equipment, so they could review video evidence together from the night of the shootings. The judge said he would consider it.

Rittenhouse, who is white, is charged with first-degree intentional homicide in the killing of two white protesters and attempted intentional homicide in the wounding of a third. He also faces a misdemeanor charge of underage firearm possession for wielding a semi-automatic rifle.

If convicted of first-degree homicide, Rittenhouse faces a mandatory life in prison sentence.

To some, Rittenhouse is a domestic terrorist whose very presence with a rifle incited the protesters in Kenosha. To others — who have become frustrated with demonstrations and unrest across the country — he’s seen as a hero who took up arms to protect businesses, including some that were damaged during unrest the previous two nights.

According to prosecutors and court documents, Rittenhouse shot and killed 36-year-old Joseph Rosenbaum, of Kenosha, after Rosenbaum threw a plastic bag at Rittenhouse, missing him, and tried to wrestle his rifle away.

While trying to get away in the immediate aftermath, Rittenhouse was captured on cellphone video saying “I just killed somebody.” According to the complaint filed by prosecutors, someone in the crowd said, “Beat him up!” and another yelled, “Get him! Get that dude!”

Video shows that Rittenhouse tripped in the street. As he was on the ground, 26-year-old Anthony Huber, of Silver Lake, hit him with a skateboard and tried to take his rifle away. Rittenhouse opened fire, killing Huber and wounding Gaige Grosskreutz, of West Allis, who was holding a handgun.

Rittenhouse’s extradition might not be an issue at all if he had been arrested in Kenosha the night of the shootings. Cellphone video that captured some of the action shows Rittenhouse afterward walking slowly toward a police vehicle with his hands up, only to be waved through by police. He returned to his Illinois home and turned himself in soon after. Police later blamed the chaotic conditions for not arresting Rittenhouse at the scene.

The killings happened two days after a white Kenosha police officer shot Blake seven times in the back, leaving him paralyzed from the waist down and sparking outrage after video of the shooting was posted online. A Wisconsin Department of Justice investigation into that shooting is ongoing. The three responding officers are on administrative leave.

Rittenhouse’s legal team includes Los Angeles-based Pierce and Lin Wood, a defamation lawyer who represented falsely accused security guard Richard Jewell in the 1996 Olympic Park bombing case in Atlanta and is a lawyer for Sean Hannity, the Fox News host with close ties to President Donald Trump.

Pierce has described Rittenhouse not as a vigilante, but as a model citizen who was cleaning graffiti from a vandalized high school before he received word from a business owner seeking help to protect what was left of his property after rioters burned two of his other buildings.

Pierce and Wood did not respond to messages ahead of Friday's hearing.

Attorney John Pierce, who has represented Kenosha, Wisconsin, shooting suspect Kyle Rittenhouse as well as more than a dozen Capitol rioters, reportedly is on a ventilator after contracting COVID-19.

Pierce's illness was first reported Wednesday after it prompted a hearing for accused Capitol rioter Shane Jenkins to be delayed, according to independent journalist Marcy Wheeler and Washington Post reporter Rachel Weiner.

"Pierce is not AT this hearing, he sent the lawyer from his office who is not barred in DC again," Wheeler reported.

"Mr. Pierce is in the hospital, we believe, with COVID-19, on a ventilator, non-responsive," one of the attorneys who was present reportedly told a judge.

The judge ultimately continued the hearing until next week, saying, "Send our best wishes to Mr. Pierce and his family."

Last week, the Daily Beast reported that Pierce recently reinvented himself as "a go-to lawyer for conservative causes célèbres."

"But even as his star rises on the right, Pierce has been undermined by a bizarre tweet appearing to threaten federal officials, an employee facing felony charges for allegedly defrauding a grandmother, and his own financial woes," the Daily Beast reported.

Jenkins, the Capitol rioter, was recently denied release after a judge determined he represents a danger to the community and a flight risk. He allegedly destroyed property while trying to break into the Capitol, and threw a flagpole and desk drawer at police.

On his Twitter account, Pierce posted several messages stating his opposition to vaccines and mask mandates:

Lawyer For More Than A Dozen Jan. 6 Defendants Is AWOL, May Have COVID, Feds Say

John Pierce, a conservative lawyer who represents 17 Capitol insurrectionists, is missing and has left his clients without legal representation since Monday last week, according to federal prosecutors.

Channing Phillips, the acting U.S. Attorney General for the District of Columbia, told the court in a case involving one of the 17 insurrectionists on Monday that his office hasn’t had contact with Pierce since August 23, and has heard “conflicting information” about Pierce’s whereabouts amid reports that the lawyer is currently hospitalized for COVID-19.

According to the court filing, Pierce’s associate, Ryan Marshall, told the court on August 25 that the attorney was “on a ventilator and non-responsive” while being treated for COVID-19, then apparently hedged the next day and said that he hadn’t personally spoken with Pierce, and that he was getting conflicting information.

“Before that hearing, Mr. Marshall told the Assistant U.S. Attorney that he had not had any direct contact with Mr. Pierce, but that one of Mr. Pierce’s friends had told him that Mr. Pierce was sick with COVID-19 and another had said he was not,” the filing reads. “During the hearing, Mr. Marshall requested, and was granted, a sealed bench conference at which to discuss Mr. Pierce’s condition.”

Phillips noted more inconsistent reports on Pierce’s health status: First a colleague of Pierce at the National Constitutional Law Union (NCLU) told NPR reporter Tom Dreisbach that Pierce was hospitalized and “appears to have been suffering from dehydration and exhaustion” but did not have COVID-19. Then Dreisbach reported later that a source close to Pierce said that the lawyer was hospitalized for the virus but was not placed on a ventilator.

Pierce’s absence and the fact that Marshall isn’t a licensed attorney means the 17 insurrectionists being represented by Pierce now “appear to be effectively without counsel,” the prosecutor wrote.

TPM has been unable to reach Pierce. His firm’s office number appears to have been disconnected, and the cell phone contact listed on his website leads to a voicemail of a person stating that the number “no longer” belongs to Pierce.

NCLU, Pierce’s non-profit, did not immediately respond to TPM’s inquiry.

Pierce, a conservative hardliner, railed against masks and the COVID-19 vaccine on Twitter earlier this year.

“This whole thing is just beyond ridiculous at this point. Take your mask off and live your life,” the lawyer tweeted last month. “We are Americans.”

In addition to the Jan. 6 defendants, Pierce represented Kyle Rittenhouse, the then-17-year-old who was charged with killing two people during the George Floyd Protests, before the teen’s family fired the attorney, claiming he had stolen from Rittenhouse’s legal defense fund.
