My understanding is most attorneys advise not to take a breathalyzer at all for those who have been drinking. They prefer that a person be taken in, and given a blood test, hoping that in the time delay that the alcohol level lowers, or that they may employ other arguments at trial.

Most states give you an automatic license suspension upon refusal, even on a field test. Still it's better than a DWI.

Based on your tip? Doubtful. Warrants aren't easily obtainable. At least from libertarian minded judges. A proactive police department is adept at making unannounced visits. Not so much looking for arrests let alone convictions as much as a device to keep the boyzz on their toes. And of course there's the old standbys like "I could smell pot coming from the home" or "while walking past a window I saw a scale with drug residue".....
