not that I agree with Cain but his loyalty test is not a religious test. Notice how tricky Cenk was when he called it ironic. That is because a religious test would typically be demanding someone swear to a belief in Allah or God or Jesus.
Depending on t the context and how it is written it may or may not pass an equal treatment or other type of constitutional test...but that is a different type of scrutiny, in my opinion.
Since I did not see the context I would bet that Cain is stating that a loyalty test could be required for those trying to immigrate here. Written properly it would probably be constitutional.

The 14th Amendment is a mess. It is so poorly drafted, it is used to justify the most outrageous acts of judicial usurpation of legislative power. Then there is the birth citizenship clause, which has been willfully misinterpreted.
