Sullivan actually wants to uphold the rule of law. Trump being the criminal that he is just happens to be predictable with his corruption.
Nothing going on here except Flynn wants to disgrace himself further. Even if the full appeals court remands it back to Flynn rather than enforcing the order to dismiss, it just means that Sullivan gets to hear it some more, make a ruling and then the government and flynn can appeal it again through the regular appeal process. Don't be surprised if the appeals court remands it, that Sullivan rules to dismiss and then- as a face saver- says that he was just enforcing his right to finish hearing the case.
Do what he will. Take the short way or the long way around. The outcome will be the same. The case will be dismissed and there will be no need for a pardon, assuming that Trump let's the case play out. If he gets pissed off and pardon's him Flynn tomorrow then that is another matter. I am saying if they play out the legal process there will be no need for a pardon.

No moron.Flynn is only protected as long as Trump is in office.If Trump loses in November than all the court proceedings you mentioned would have to happen before Trump leaves office in January.If Sullivan loses to the full court,not likely since its 7 democrats and 4 republicans,than Sullivan can appeal to The Supreme Court,and that would take around a year.Trump would be long gone from office by than.The fact that the full court agreed to hear the case is bad news for Flynn because that rarely happens after a 3 judge panel issues a ruling.
If Trump loses Sullivan wouldn't need to continue to The Supreme Court , Bidens AG can just withdraw Barrs motion to dismiss the case and the case goes to sentencing with Sullivan deciding how much time in prison Flynn gets.Flynn would be an idiot to not take a pardon.

As overdiscussed at length, Judge Butthurt can take the long way around or could have ended it efficiently -either way, the outcome will be the same. If the DOJ does not want to prosecute the case, he cannot order it.
Sullivan may win on the narrow issue of whether a judge is entitled to make a final ruling and then the defendant can appeal that (versus running up to appeals court for a mandamus to dismiss), and that is fine. If he wants to pretend that he was going to dismiss it anyway to save face, go for it. Other than the fact that it just drags the case out longer and longer I don't think Barr objects to that. It was Flynn's lawyer that took it up to the appeals court- not the DOJ- but the DOJ had to make their case when the appeals court panel decided to hear it. I think Barr fully expected to just let Judge Butthurt either dismiss it or if he didn't they would appeal in the normal manner.

Maybe the lefties here can bring their old buddy Abdul El Tony back when the case is ultimately dismissed just so that I can discuss it then.
