The judge can drop it now but if he wants to continue to fight he can.He certainly should considering the next appeal would be 7-4 democrat judges.

If the judge were a politician that would be a factor.
Should a judge be shopping appeals courts to press a prosecution that the government wants to drop? No.
This judge is not a judge. He is a hack politician. I see guys destroy their reputation in the last phase of their career all the time. John Bolton comes to mind.
A judge really has one job. Impartiality. Emmet Sullivan is a failure.

I think Bolton and Sullivan have both greatly improved their reputations.
The prosecution decided the drop the charges.
Should the judge then become prosecutor? No.
If you don't like Barr and Trump you should elect someone to replace them. Instead you've nominated someone with one foot in the grave and the other on a banana peel.
