It's the same law for all states, which provides for one type of treatment if the state has attribute X, and provides for another type of treatment if the state has attribute Y. If you don't like the the treatment you get for doing X, don't do X, do Y. That's the general idea behind laws (and sanctions).
Edit: admittedly, Congress does need to periodically reevaluate the states for these attributes.
