I am in disbelief that a court ordered Smollet to be released while he appeals. This is not a case where there are real grounds for an appeal or an appeal is likely to be successful. As you stated this is what privilege looks like.

Nah this was a victimless crime.Privilege would be multiple financial crimes and starting insurrections and walking free.Privilege would be strolling the streets at 12 at night with an AR 15 looking for trouble and killing 3 people.Privilege would be all the criminals Trump pardoned.Privilege would be assaulting and killing daily and getting away with it 99% of the time.

people get out on bond all the time for non violent offenses with longer prison sentences... not sure this is priviledge but rather how bond/bail works.

People usually don't get out of jail AFTER being sentenced. Bond/Bail only comes into play typically before an individual is sentenced.

If he is allowed out pending appeal its just an assessment that he will return for that appeal and not flee. He still has the conviction and sentence and will serve that sentence if his appeal is unsuccessful.

It is a 5 month sentence.... assuming an appeal can take longer than 5 months it would be "cruel and unusual punishment" for him to stay in prison waiting for an appeal for longer than what his actual prison sentence is. Obviously his appeal will fail miserably but he still has a right to file it and since it is non violent it was his only means to delay prison which is all he is doing..
Judge probably knows he is not a flight risk and he was released on conditions he stay in the area. Might have even had to give up his passport.

Bottom line: Smollett is being treated with privilege by the justice system -- which was the entire problem with the initial investigation & DA's office interactions with him.

My guess was that he would probably only do 4 weeks or so then get out anyway.

This is all about him being unable to admit to his actions... at this point.

you have a list of everyone who files an appeal on a non violent crime with a misdemeanor sentence to see who got released on bond?
