At the time of my writing, yes he was still employed, and his character being cut from the last two episodes of the current season isn't technically terminated for good. Nowhere can i find that the producer's of the show have said Smollett is cut for good. It's their call and actally Jussie coming back as an ex-con would probably be good for ratings given the nature of the show.
