Shorting Stocks?

there are (2) stocks that I my automated system shorted, well at least attempted to short today

CREE and TMR

At 632 and 636 I sent an order to sell short at market. I didn't get filled. I though that they did away with that uptick rule.
 
I called, one of them was not available for short sale, and the other one those idiots at the NYSE didn't open the stock yet, hence a market order was cancelled
