short sale and ownership

I some questions regarding short sale. Hope your gurus can help.
1. If I short sale a stock, does the ownership of the stock transfer from the lender to the buyer of the stock?

2. If a stock involves a tender and one shareholder tendered his shares. Is his shares still available for lending?
