"state rights" amirite?
The plaintiffs are claiming harvard and unc (private and public) both get federal funds via grants and scholarships and aid so they are using that hook to make it a SC case. (for Harvard, UNC is a State university so falls under 14th A).
What I find funny is the Supreme Court existed for more than 150 years while Blacks were excluded from UNC, a public university and it was ok for the school to take race into account using a quota (ZERO Blacks), now conservatives complain that it is unfair to do so.

First Black Undergraduates admitted 1955
Zero complaints from Whites about race based system in that time period: ZERO
Also UNC White, non hispanic students in total undergrad: 55%
White students are suing because they are..... underrepresented?
I think in 2020 White, non-hispanics were 58% of the population?
