Republican Special Prosecutor Ken Starr: Presidents Can Be Indicted

A newfound memo from Kenneth W. Starr’s independent counsel investigation into President Bill Clinton sheds fresh light on a constitutional puzzle that is taking on mounting significance amid the Trump-Russia inquiry: Can a sitting president be indicted?

The 56-page memo, locked in the National Archives for nearly two decades and obtained by The New York Times under the Freedom of Information Act, amounts to the most thorough government-commissioned analysis rejecting a generally held view that presidents are immune from prosecution while in office.

“It is proper, constitutional, and legal for a federal grand jury to indict a sitting president for serious criminal acts that are not part of, and are contrary to, the president’s official duties,” the Starr office memo concludes. “In this country, no one, even President Clinton, is above the law.”

Mr. Starr assigned Ronald Rotunda, a prominent conservative professor of constitutional law and ethics whom Mr. Starr hired as a consultant on his legal team, to write the memo in spring 1998 after deputies advised him that they had gathered enough evidence to ask a grand jury to indict Mr. Clinton, the memo shows.

Other prosecutors working for Mr. Starr developed a draft indictment of Mr. Clinton, which The Times has also requested be made public. The National Archives has not processed that file to determine whether it is exempt from disclosure under grand-jury secrecy rules.

In 1974, the Watergate special counsel, Leon Jaworski, had also received a memo from his staff saying he could indict the president, in that instance Richard M. Nixon, while he was in office, and later made that case in a court brief. Those documents, however, explore the topic significantly less extensively than the Starr office memo.

Geez, what would be more in line with current DOJ policy - a 1998 memo authored by contractor Ken Starr or a circa 2000 Department of Justice Policy opinion published by the DOJ Office of Legal Counsel?

Hint: when Mueller took on the job he agreed to follow all DOJ policies and procedures. In fact, the Special Counsel law codifies that he must. He cannot indict President Trump. He can write a report to Congress recommending it, but he himself cannot formally indict a sitting President.

I like how you cons have totally given up the pretense of 'law and order' and are reduced to arguing technicality to protect your criminal. It's doubly ironic considering you cons couldn't stop bringing up Hillary for not being prosecuted for her crimes but Trump can't be prosecuted even if there is evidence because of 'DOJ POLICIES' - the same DOJ policies that Comey violated to help elect Trump.

Hint: Nobody gives a shit about copy pasta legal opinions, I am sure Mueller knows how to deal with criminals regardless of their political position.
 
1. I don't believe for a second that Mueller and Rosenswamp would not move to indict Trump (President or Not) if they had evidence he were guilty of a significant crime. Internal policy can be changed.

2. Whether they were legally allowed to indict or not would be litigated in the courts. I don't think we know the answer to whether it is legal or not to indict a sitting president or prosecute him for a crime? And the courts are political creatures lately. The more serious the crime the more likely they would probably let a prosecution move forward. For instance campaign finance charges might not be allowed to move forward. Selling out our national security interests for cash ... what non compromised non biased court would not allow that to be prosecuted?

3. There is a chance this is just a Muller smoke screen to let the dems down easy that there is no evidence of a crime... or its some sort of condition set by Trumps team to get him to agree to talk with Muellers team.

In short this was not a just a recent "oh we figured out we can't indict him per DOJ policy". There is more to it than that.
