Stephen Breyer’s Apparent Retirement Plan Will Backfire

The New York Times reported last month that Supreme Court Justice Stephen Breyer, age 82, has been resisting calls for his retirement from fellow progressives. The reason? Breyer apparently worries that retiring in the face of a public pressure campaign from Democrats will increase polarization and a politicized view of the Supreme Court. In reality, a Breyer retirement delay could well have the opposite effect. If Breyer delays too long and Democrats lose control of the Senate before a successor is chosen, then Mitch McConnell could have the opportunity to block a Breyer replacement and supercharge the last five years of intense polarization around the court.

It’s not hard to imagine how a Breyer delay increases the politicization of the court. Breyer waits to retire for a couple of more years, or even a few more months. Democrats lose control of the Senate in the 2022 midterm elections, or because an elderly member of their bare Senate majority passes away and gets replaced with a Republican, restoring Mitch McConnell to his perch as Senate majority leader. Breyer dies or becomes ill soon after Republicans retake the Senate and leaves the court. President Joe Biden, fulfilling his campaign pledge to nominate a Black woman to the Supreme Court, chooses a judicial superstar like California Supreme Court Justice Leondra Kruger or (soon-to-be D.C. Circuit Judge) Ketanji Brown Jackson. McConnell shamelessly announces that Republicans will hold no hearings for a Supreme Court justice until after the 2024 presidential elections, much like he ran out the clock on a hearing for Merrick Garland to fill the late Justice Antonin Scalia’s seat. Democrats stage protests about the blockade of the nominee, and the nominee’s face is featured prominently in advertising about the court. A key debate in the 2024 presidential election is about who is going to take the seat on the Supreme Court, with knowledge that not only Breyer’s spot, but also likely the seats of Justices Clarence Thomas and Samuel Alito (two staunch conservatives) could open up with a Republican presidential win in 2024. The court is once again the political football in our national arena.

If he was planning to retire this is probably the best way to do it,trying to make it seem the decision wasn't political.
 
The lefties have the same "inconvenient reality" with Breyer that they had with Ruthie.

The dem politicians all think that packing the court is the greatest idea since sliced bread, but both Breyer and Ruthie were adamantly opposed to it and thought that it was a dumb idea.

I get that the legislative branch decides the number of justices regardless of what justices say, but let's just say that the sitting court members are in a position to say things that influence others in this matter.

The court packing that the dems will probably succeed in doing is getting lower level appeals court judges appointed under the guise of helping with the workload. So those would be new and additional judges/justices. But when a case is heard en banc- ie by the full panel- it means that all will decide together including the new justices added. That will also allow them to put more lefty judges in the wings to showcase themselves for Supreme Court appointments. All of this presupposes that dems will be in power and the dems proceed with that assumption. Be careful though. Surprises happen. I am not necessarily opposed to adding some additional judges on a phased in basis such that it cuts across at least one election. Also, the nineth circuit needs to be broken up. It's jurisdiction is an unruly mess, both for the court and the states covered.

This is the same fucking idiot that thought he was a federal judicial expert who argued for months that federal judges would throw out the Flynn case without the need of a pardon


As I have said many times, Judge Asshole can keep this thing going for several more rounds if he wants. It is just a matter of how much he wants to disgrace himself with his superiors and colleagues. The outcome wil be the same though. Flynn is going to walk and not need a pardon to do it.




Until we see a decision (not going to) by a higher court that says that the judge can order the prosecution of a case when the state says it no longer has a case that it can stand by, then everything continues to be aggravation and delay fro Flynn but does not change what the outcome will be. And I am talking without a pardon. Pardon not needed.

Washington (CNN) - Justice Stephen Breyer's latest signal, in comments made exclusively to CNN, that he is not yet ready to retire from the Supreme Court is angering progressive advocates and leading legal observers to wonder whether the left's pressure campaign on Breyer backfired.
