Protecting Assets From a Divorce

Quote from mgookin:

I ended up with a team of three attorneys and five expert witnesses to testify what my assets were worth, and to testify what her assets were worth. I pulled a building permit and gutted my primary residence and let it sit like that until after divorce. The value of that home at time of divorce was the value prior to the demolition minus the cost to restore it to the condition prior to the demolition. See where I'm going? It's how the numbers work out and how the court is or is not willing to accept the numbers. Cars are easy to show as not worth much; boats too. As to investments, they had a value at time of marraige and a value at time of dissolution of marraige. But this stuff is for later if that time ever comes.

Your objective at this point is to protect your assets from any future claim.
Wow, you approached your divorce like a General about to go to War.

I am so impressed ... shit, I'm in awe. :)

Divorce is war.

There is an enemy and you need both offense and defense.

I'm not an attorney but I spent 15 years working in the compliance department of a government office. I am quite experienced at reading law and screwing the person at the other end :)

Greatest thread ever!!

About keeping assets in a trust/corp./LLC... Can't any half-assed lawyer get a charging order for 50% of the entity?

I'm not sure which of us you're asking... several of us mentioned trust/corp/LLC.

As far as the response I laid out, a US judge has no jurisdiction over foreign assets that are not owned by you. Likewise, if your car lease is paid for by a foreign corporation, as part of the job perks they offered you, there is nothing to attach or get a charging order for... you can only attach a charging order to assets. A lease isn't an asset - it's a liability. Obviously, it does no good to try and get a charging order here in the USA on a foreign corporation's payments to you... as it can easily just stop paying you, or "fire" you for personal reasons. It can, of course, get money to you by pre-charging a CIRRUS debit card each pay period.

Don't do it.

I tell you from the bottom of my heart. Especially if you have money DO NOT DO IT.

From a man point of view there is absolutely nothing to gain in a marriage. Anything you can do by marry her you can do without marrying her.

You can have kinds, you can live together, you can love her.

Do you think it is right to go to the DMV and sign a contract to express your love for someone ?

It is nothing but a contract and it will bite you back eventually.

REMEMBER: when your heart is broken your wallet is what is going to carry you on.

Quote from Barth Vader:

I am going on 25 years..........I could not think of going through this life without her.
I have made fortunes and lost them, she has stayed the same through it all. She is loyal, smart, a great mom and a great cook !!

15 years here and two fantastic kids. i am very happy because i operate differently than most of my friends. i am not stubborn and say she is right when she is clearly out of her mind. if a guy thinks life is rational and clear and tries to force his wife to behave that way....divorce court will be the result. you have to bend and realize she has wants that will be so different from yours. also, having plenty of money eliminates many of the standard arguments. i really believe many of the bad marriages and divorce's are the results of selfish behavior's. most of the single posters should stay single until they can learn to compromise. jmo of course.

Mistake ?

The only mistake is to get married.

Marriage is for guys who got nothing going on for themselves. No ambitions, no nothing, because if you do see yourself being sucessful one day then why would you sign a contract to give away 1/2 f what you got ?

Marriage is for fools, just like fat women are for poor men.

It's a fact.
