Yes it was resummitted to Clarence Thomas and is on the docket for 12/05.

It might be in their best interest at this point to report this critically important meeting to take place on December 5, 2008, or lose what little credibility they have left.

The case as brought is interesting in that it seeks to require the sec of state of NJ to determine if the candidates on the ballot are qualified by law to serve for the office they are running for.
By naming all the presidential candidates in the motion it elimintes picking out just Obama.
My guess is that the Supreme Courts sides with plantiff and the sec of state of NJ has to decide what is more important, her career or Obama being president. She could very well sign off saying she is satisfied that he is an American citizen and just take the heat for it.
However, there are now 10 states with similar suits so we will see.
