‘Move for a mistrial’: Legal analyst says Adam Schiff must end Senate trial before GOP acquits Trump


NBC legal analyst Glenn Kirschner on Sunday addressed the possibility that Chief Justice John Roberts could declare a mistrial before Republicans in the Senate acquit President Donald Trump on impeachment charges on Wednesday.

Kirshner argued that House Impeachment Manager Adam Schiff could call for a mistrial even though such a move is not contemplated in Senate rules.

“I wish Schiff WOULD make a motion for a mistrial based on, among other things, the revelation of [Pat] Cipollone’s grossly unethical conduct/conflicts of interest,” Kirshner wrote on Twitter, referring to allegations that the president’s attorney witnessed presidential high crimes.

“The Senate rules may not contemplate/authorize a mistrial motion,” he admitted. ‘I would argue the rules as adopted NEVER contemplated the president’s lawyers would have hidden from the Senate, the Chief Justice and the American people such egregious, disqualifying information (as recently disclosed by John Bolton).”


Kirshner concluded: “Cipollone perpetrated a unimaginable fraud on the Senate and the American people and the Dems should not go quietly into that dark acquittal. Move for a mistrial and see what the Chief Justice says.”

Roberts has already stated and clarified that he will not be ruling on motions other than to present them to the Senate to vote on. Try to keep up, and better luck next time.

In an impeachment the senate has final authority over all motions. They can allow the presiding justice to make rulings just to facilitate the process on minor matters or even substantive matters and let the decision stand if they are okay with it, but they are not, the senate can overrule. And the republicans are in the majority every step of the way.

And I have just given you the short version. Otherwise the constitution provides for a conviction or an acquittal. Not a mistrial. There is no double jeopardy on impeachment so if there is an acquittal the house can just bring the case again. I know many tards are talking excitedly about that. Go for it. The Republicans have the votes to do a dismissal or summary judgment on the record the hour it arrives. If the tards think they this impeachment scam is a winner, they should do it every month. That's fine. And having senators running for president cloistered in the senate right before SuperTuesday would be beautific. Sign me up.

The founders would have plenty to say about the abuse of the impeachment process to overturn an election and the next one too.

Schumer says "an acquittal of Trump will have no value and be meaningless." Really dipshit? It means the difference between Trump leaving or being there for two terms.

Elections don't matter because we have an Electoral College, impeachment acquittals don't matter because the dems could not get the votes, etc. etc. And we know that the next election does not matter if a dem does not win. Okay fine. Trump will be sitting in the Oval Office while it is not mattering to you.
