A great deal of intellectual property produced in this country after 1923 is not in the public domain. If it were in the public domain, why hasn't someone put it out on DVD and sold it? Clearly, there is a market for it.
That said, I didn't see any copyright mention on the video posted on youtube, but that does not mean that the item was not copyrighted.
Even if someone dies, copyright can be passed down to one's heirs.
