Usually when there are at least two sides to an issue, the majority will side with the least defective logic, but occasionally the majority does not. Thus we see illustrated in the majority opinion both the great strength and the Achilles' heel of democracy in one fell swoop, or as a colleague of mine liked to say "in one swell foop!"

In the present case, it would seem opinions line up as they usually do in a democracy.
