For the last time, the system was changed to incorporate minorities (who obviously couldn't compete solely based on grades), under the original system the top student was pres, he was NOT the top student. That was my point in the post that u quoted, it still stands.

Plus while he may have graduated in the top 10%, I don't see anything that specifies that he would automatically be an editor.. we don't know his class size, nor the amount of editors in his class. Plus he has admitted himself that he "may have benefited from AA during his academic career". We don't know what his grades were before Harvard and we don't know if he was admitted to HLS based on AA or not. But assuming his grades were exceptional and he qualified as an editor without AA.. see first sentence.

What does this matter anyway? his comments about the SC this week display either ignorance of the Constitution and role of the SC, OR disregard for the same laws and roles outlined in the Constitution.
 
Legislating from the bench is a bad idea, unless of course you're on the other side of the argument. Then it's a good idea, very good.

In the laugh of the day column. Here is Nancy Pelosi's prediction today on the SCOTUS vote on ObamaCare.

"I'm predicting 6-3 in favor," Mrs. Pelosi told the Paley Center for Media. "We shall see. It's a lesson in civics, and I respect it."

She didn't say which six justices she thought would uphold the law.

We all agree with that.

Now its not legislation if a law is struck down because it runs counter to the life and liberty protected by our constitution. That is the courts role.

Finding new laws and new powers is what is legislating from the bench. Making special classes of people and contorting plain meaning... that is legislating from the bench.

Show me Supreme Court precedent which declares a person born to a a Kenyan National is a Natural Born U.S. Citizen. Not just a U.S. citizen but a Natural Born Citizen.

She's assuming Roberts will join Kennedy and uphold it, based on sideline, 4th estate analysis.
