Trump's team filed the motion for a mistrial Wednesday, citing Judge Arthur Engoron's past social posts on an alumni page for Wheatley School. In the posts, the judge appears to reference the case, as well as Trump and members of the former president's family.
"In this case, the evidence of apparent and actual bias is tangible and overwhelming," wrote Trump lawyers Clifford Robert and Alina Habba.

In a filing that supported ending a temporary pause on the gag order, an officer with the New York state court system’s Department of Public Safety said the judge presiding over the case, Arthur Engoron, had already been the subject of harassment and threats on social media that were deemed “credible” before the trial started in early October.
Those threats prompted court officials to work with "the FBI and Homeland Security to devise the appropriate security measures that would be implemented in order to protect the judge, his chambers staff, and those closely associated around him, including his family," Charles Hollon, who works in the Public Safety Department’s Judicial Threats Assessment Unit, said in the filing.
Then, on the second day of the trial, Trump posted a message on Truth Social identifying Engoron's principal law clerk and falsely claiming she was in a relationship with Senate Majority Leader Chuck Schumer, D-N.Y. While Trump himself did not threaten her, Hollon said, "the comments made in his post resulted in hundreds of threatening and harassing voicemail messages that have been transcribed into over 275 single spaced pages."
An attorney for Trump did not immediately respond to a request for comment Wednesday night.

This type of lending is typical in high net-worth, high-profile clients like Donald Trump. Anyone with basic knowledge of banking, lending, portfolio and credit risk management knows this.
David Williams, a managing director at Deutsche Bank, testified yesterday the bank was happy with Trump's financial health when he applied for the loans and the bank conducted their own due diligence. Even after making an internal billion dollar adjustment after a stress test, they were still satisfied with Trump's ability to repay. Specifically, Trump tried to claim that he had nothing to do with that gross overvaluation of his own property and he instead tried to pin the blame on others within the Trump Organization for the error.
However, a new audio recording obtained by Forbes reveals that Trump back in 2015 recited the false square footage numbers of the penthouse during an interview where he boasted about his assets.
“This is the entire floor of Trump Tower, just so you understand,” Trump said in the interview. “This isn’t like, I’ll show you. Now, this wraps all around the building. All around the elevators. And I have three times three. So there’s like 11,000 feet on a floor. So I have three. So 33,000—and I have the roof.”
In fact, the total square footage of the apartment was just under 11,000 square feet.
Forbes also notes that the recording undercuts Trump's claims made at the trial that he had personally noticed the problem and had ordered his accountants to correct it.
"In fact, Forbes uncovered the square-footage discrepancy and informed Weisselberg and McConney that the apartment was 10,996 square feet in February of 2017," writes Forbes. "The Trump Organization nonetheless continued to use the incorrect square footage on a net-worth statement dated mid-March. Forbes then published an article headlined 'Donald Trump Has Been Lying About The Size Of His Penthouse' in May 2017. It was only after that story came out—while Donald Trump was in the White House—that the Trump Organization changed its calculation to reflect the true square footage of the apartment."
