Fourth and Fifth Causes of Action

Defendants Donald Trump, Allen Weisselberg, Jeffrey McConney, Eric Trump, Donald Trump, Jr., and all of the entity defendants are liable under the fourth cause for action for repeatedly and persistently issuing false financial statements, thus violating Executive Law § 63(12) and New York Penal Law § 175.45. All defendants are liable under the fifth cause of action for conspiracy to submit false financial statements. As detailed in the Findings of Fact, there is ample evidence that each of the individual defendants, with the intent to defraud, “knowingly ma[de] or utter[ed] a written instrument which purports to describe the financial condition or ability to pay of some person and which is inaccurate in some material respect.” PL § 175.45(1). There is even more evidence that each of the defendants participated in a conspiracy to submit false financial statements.



It is amazing someone can get owned repeatedly and yet still think they can dig out of the hole...
This should have been made in criminal court. It wasn't as it didn't pass muster. This case was a canard from the beginning and is ripe for appeal across many avenues. I expect an overturning in the end.
 
I expect strong arguments on appeal to be with regard to the 8th amendment and 14th amendment.

Arthur Engoron rejected a request from former President Trump's attorneys to postpone enforcement of a $355 million fine he owes in the civil fraud trial over his business practices, per court filings.

Why it matters: The GOP presidential frontrunner has been seeking to get delays and mistrials in various court cases, with the latest dealing him a massive financial blow after he was recently ordered to pay $83.3 million in a separate trial.

The U.S. courts have grown tired of this bullshitter's delay tactics. In my opinion, it's the primary reason why he's running for President of the United States to try to find a way to delay or dismiss any civil & criminal cases.
