I think the term is 'malicious prosecution'. There should be a law that allows counter-suits based on evidence of malicious prosecution. Meanwhile, the prosecutor should be required to bond up, in case he has to pay for malicious prosecution.

I would have to look it up but I have trades bubbling and percolating right now, but I believe there is such a law.

I think it was a Henry Hyde amendment, not to be confused with the abortion Hyde Amendment.

At some point the funding for ongoing prosecution should be relieved from taxpayers, and assigned to a private consortium of interested parties, such as foreign agents like exGOPer.

Discovery is supposed to eliminate the element of surprise in court. Surprises in court are unfair, like releasing dirt before an election, without enough time for the other candidate to respond. Discovery assures the case is fully litigated, and also increases chances of an out-of-court settlement, saving the costs of court. Without it, court is open to all sorts of shenanegans. Avoiding discovery indicates shenanegans are already afoot, indicating malicious prosecution. For this reason, the cost of prosecution should be taken off the backs of taxpayers and turned over to any group of private takers and foreign agents.
