Mueller admits: Can’t Indict a Sitting President

This is from what I can dig up - I’m certainly no expert. I just read a Georgetown Law white paper on this.

DOJ policy is very clear about this; a number of Constitutional scholars agree but some do not. The protocol is: impeachment must precede criminal indictment and prosecution. In lieu of impeachment - being voted out of office or term expiration.

It’s important to separate clearly defined, well known, long standing DOJ policy versus what various Constitional lawyers and talking heads argue about in the media.

From what I can tell Mueller is simply saying that he will abide by DOJ policy.
 
Muller didnt say that Rudy did.And its just current DOJ policy which could change.Ken Starr and The Nixon prosecutor said a President can indicted.Fox News top lawyer Napilatino said so as well

1. CNN asked Mueller to comment on the matter and he declined. He certainly could have refuted or denied saying that to Trump’s lawyers - but he didn’t.

2. This particular DOJ policy will not change under the current administration. The Attorney General’s signed approval is required for departmental policy changes and that ain’t going to happen.

3. Any argument made by any media talking head will not change DOJ policy.

4. Rosenstein cannot unilaterally change established DOJ policy without the Attorney General’s signed approval and that ain’t gonna happen either.

You dont know what Sessions will do, he may consider himself recused or just not want to been seen as protecting trump from prosecution.
