His argument is that you can't impeach someone after they have left office. There is historic precedence against his stance, but this sets up a new world where a president is above the law while he is president and can't be held accountable after he leaves office.

For all your Constitution loving patriots out there, you should be thrilled that Biden can do whatever he wants and can't be held accountable. If Biden and the Democrats thought like a proper patriotic Republicans, they will round up a bunch of Republicans, and he will personally shoot them on 5th Avenue in broad daylight. You can't touch him.

His argument is correct that you cannot try a president in The Senate after they have left office and no, there is not historic precedent against his stance.
 
What Federal precedent says Congress can impeach a President, not in office?
Real question... not trying to argue... yet.

I have never seen any precedent mentioned.
Its just a bunch scholars and pundits arguing for their point of view.

As I have said before numerous times on the board and was argued with, sitting presidents are above the law.

There are no specifics in the Constitution, but Belknap is all the precedent they need... and it was a bipartisan majority vote (56/44) as Constitutional.

And of course you're wrong. Trump was impeached both times while holding the office of POTUS.
