In Surf's case, he failed to meet the objective criteria and is ineligible for funding even if he were to get to $3500. The combine has parameters for daily loss and profit volatility that knock him out.
Bottom line is he who holds the money calls the shots
If you don't like this deal then find another way to make it happen
