The judge is just letting the prosecutor know that he sees his gig and what he is up to.
Just so that there are no surprises, Rosenswamp wrote the appointment and scope letter for Mueller, and since his goal and the goal of the special counsel is to get Trump, there is ZERO CHANCE that he did not authorize him to prosecute any other crimes he came across as a means of squeezing Trump. It would be worded as "and such other crimes that may arise during the course of the investigation" kind of wild card.
The judge knows that too. Again, he is just signaling to the Justice Department that he knows that they are crooks as most Americans do now so they should not expect any free passes.
And of course the judge gets to control what kind of arguments the defense gets to put on before the jury and the instructions to the jury as to what they can consider. If the defense wants to argue an abuse of prosecutorial power to achieve a political objective and instruct the jury that they are free to consider that in their deliberations- well then- so be it.
And further, even if there is a conviction, guess who gets to determine the sentencing. Yup, that's right. The judge who has already let you know that he sees the witch-hunt for what it s.

What it the wide net is being cast due to the scope and size of the initial investigation?
You're making the assumption that there's nothing there.
I believe it has been stated many times here by yours truly that Muellers history is that he has always been very aggressive and he and his sidekick Weisman have lots of fun swinging dick around town BUT things start getting rough mighty fast the minute he has to go to court and deal with judges and defense teams.
Today was a classic example.
And as always, more to come on Flynn too. Although it is late in the process I would not be surprised if his plea deal is set aside. If not the judge can always just give him a suspended sentence. The original judge has been removed and the new judge sees what the gig is there too. Since his plea, it has been revealed that the interviewing agents (strozk was one) reported that they did not believe he was lying and comey reported the same to Congress. But - Mueller did not reveal that to Flynn and went ahead and squeezed him anyway- not upon the facts but just by squeezing him. The facts are that the agents and comey reported that they had no reason to believe he was lying. Then that was set aside when Mueller needed to try to get him to flip for some reason.

That's kinda how our whole justice system is supposed to work, no? Innocent until proven guilty.
Unfortunately in a Mueller stormtrooper environment, the system is one where you bust the guys door down in the middle of the night in front of his wife and kids, immediately causing the accused to sell his house to pay for the legal fees and immediately ruin his professional and personal reputation. Then you ask the defendant if they would produce stuff on trump as a way out. - except you never get your house or your reputation back.
Someone asked on one of the programs why Hope Hicks left. And someone else replied that probably it was because just having to testify to mueller a couple times cost her more in legal fees than she made for a year at the white house. And she is one of the milder examples.
It's about undoing an election. I dont whether the judge yesterday went off the reservation by just coming out and saying that or whether he actually went back on to the reservation by giving a reminder of what the system is supposed to be. "no one wants to see unfettered power in this country." or words close to that from the judge.
Yeah, and without being involved in the investigation, I can't make a judgment that the scope is too wide. That's up to the courts and judges issuing the orders.
Having the following rhetoric undermines the judicial severely, when the executive are in fact the ones struggling with credibility.
