Even Fox News says this former marine has a tough legal road ahead. The use of force needs to be proportional --- the only time you can use deadly force is when you are in obvious fear for your life.

I do find it funny that the protestors are the same people that would walk by the homeless and do nothing or react if a home less person came up to them scremaing and moving their arms or harrassing them.... suddenly they are concerned about this guy.

That being said you cannot choke someone out and kill them no matter what so all this talk about a marine, a homeless person or the color of either skin is truly irrelevant. You cannot just go take someone down and choke them out to death...it is manslaughter.

Same if this happened in a bar or in an airport and if both people were purple. Gonna be difficult for the marine to avoid some type of legal charge because the law wants to make sure citizens cannot go around and just kill anyone they want on the streets, homeless or not.
