My question is simple. If these people on the terrorist watch list or no fly list are not american citizens, why are they still here? Why don't we kick them out and solve the problem. The San Bernadino killers got their guns from their muslim neighbor, which is interesting in its own right, since muslims are all so peaceful, etc.
Granted, it's a little more difficult if they are citizens, but you don't solve these problems all at once. You take a step here, a step there, to make life more difficult for them.
Restricting the right of people on the terrorist watch list to buy weapons has an intrinsic appeal, but it runs into many roadblocks. The first is that we have to take a no compromise position on gun control. We know the anti-gun groups are relentless and will try to exploit any opportunity to restrict our rights. If these people are so dangerous, why not impose a curfew on them and require them to wear monitoring devices? Is that any more of an imposition than taking away their constitutional right to keep arms? Why not require them to waive their right against warrantless searches? Wouldn't that be more of a deterrent?
Second, we know that we cannot trust obama and the democrats with this kind of limitless power. They could put the entire state of SC on the list, just to punish them. Or Texas. There is no right of appeal, no notice, no due process.
Third, if you do want to restrict their rights, to be constitutional, you do have to give them notice and an opportunity to be heard before a judge. This could pose security problems in terms of revealing secret information or exposing informants, plus be an administrative nightmare, since there are over 50k people on the list apparently.
