kobe faces life in prison (that's a bit much, imo)

Quote from Magna:

...If Kobe is guilty, if he did what is alleged, then he will have raped this poor girl
[yes, this unstable, suicidal teenager who was awestruck by this famous person, willingly entered his room, kissed him, gave no indication to an eye-witness at the hotel upon leaving that anything unruly had happened, didn't tell her investigating officer during the first interview that she had ever said "No", showed up to the hospital the next day wearing different panties soiled by another man's semen and pubic hair]

Yes, if Kobe is guilty, then she is a poor girl who has to suffer not only a rape, but the trial process.

...and forced her to go through this awful trial process where she is forced to prove she is not guilty of lying.
[yes, sorry, she can't simply make the claim and have it stand at that although from your posts I suspect you would prefer it that way]

I would prefer that all rape trials, and all aspects of the process are sealed to protect both parties, until guilt or innocence is determined by a jury.

...If he ruined her life
[please, enough melodrama, she hasn't even hit 20 yet, nothing is ruined]

If Kobe raped this poor girl, then her life is ruined. Do some research on victims of rape, and see how the impact effects the remainder of their lives, especially in a high profile case like this.

...If Kobe is guilty of rape then life in prison is a fair punishment in this case.
[I'm sure Kobe appreciates your unbiased impartiality in deciding his punishment, life in prison, the ruination of his career and his family, all for a few minutes of sex that may have easily been consentual.]

If Kobe is guilty of rape, then life in prison in my opinion is a fair consequence. Apparently you view rape as little more than a sexual act, which all experts will tell you that it is not.

...What I am saying is that if Kobe is guilty, then he is forcing this trial. He could simply plead guilty, no?

[I suppose with that logic anyone who ever defends themselves against claims by another person or the government is "forcing" a trial and should forego "forcing" by always pleading guilty]

Yes, if people who know they are guilty, lie in order to avoid punishment, they are in effect forcing a trial. A trial is not necessary, but by their own choice if in fact they are guilty.

...What a woman has to endure if she is innocent is awful.
[true, and what a man has to go thru, in expense, in cost to his family, his career, a portion (or all) of his life in prison if wrongly convicted, is also awful]

Yes, false accusation is a horrible experience. One has to wonder why Kobe would have allowed himself to be placed in this position. Where were the body guards?

...this girl, if innocent in the respect that she is telling us the truth, that Kobe did indeed rape her, will suffer greatly
[the melodrama continues... And if she was lying will she go to jail for costing this man millions of dollars, potentially ruining his livelihood and his family, in fact his very life itself? No. In fact, nothing will happen to her.]

If she testifies in court, and is lying and if there is proof of that lie, then she can be found guilty of perjury, and jailed/and subject to a civil trial.

...The full weight of the prosecution is much less that the defense
[prosecutors from the entire state of Colorado have offered to pitch in and do whatever is necessary to assist, using the full resources of all their offices, so it's not just a couple of "understaffed" local prosecutors]

Who can afford to hire the best expert witnesses? Are the best attorney's in the offices of the DA, or in private practice?

...This is not going to be a racial case, unless the scummy defense tries to pull the race card
[but how do you really feel about the defense?]

If they pull the race card, they are scummy. If they said there was evidence at the pre-trial knowingly to poison the jury pool, but in fact it is not evidence that is admissible or fact, they are scummy. Not that I wouldn't want a scummy attorney to defend my life, but scummy is scummy. Mackie used the girl's name 6 times in direct violation fo the judge's order not to. That is scummy too.

...This attempt to poison the jury pool by Mackie & company
[those dastardly lawyers, not that I would ever suggest the prosecution was also actively trying to poison the jury pool by continually leaking damaging, unsubstantiated claims against Kobe]

This is the reason that all these trials and all aspects should be kept from the public, until after the trial to avoid poisoning of the juries.

Why doesn't Kobe take a lie detector test?

Sure, it it not admissible in court, but that information, assuming he could pass, would really poison the jury pool.

Are they afraid he would fail? They could have the person giving the lie detector test sign a waver that he would not release the findings to the public himself, so if Kobe did take a test and fail, we would never know.

In fact, we don't know that he hasn't already taken one and failed, do we?

Quote from aphexcoil:

If I'm not mistaken, life in prison is the maximum penalty for what Kobe allegedly did. The judge will of course use discretion when sentencing due to the circumstances surrounding the case.

If Kobe were to be found guilty of rape, I believe his sentence will be similar to Mike Tyson's sentence -- 5 years in jail. Kobe would then be eligible for parole probably shortly after serving approximately 2 and a half years of his sentence.

Obviously life in jail would only be used for the most brutal of rape cases.

According to a Sports Illustrade article, the way sex laws are set up in Colorado the sentence for rape is 4 yrs to life, they let you out when they feel you have been rehabilitated. For as long as these sentencing guidelines have been in place nobody has been released in four years.

I would have to agree with Gordon that this penalty is too severe for a he said she said case.

Not one of you people, not one, has ANY knowledge of what went on in this case. Not one of you has any firsthand knowledge of the girls, emotional state, sexual history, or personal integrity. Yet you so freely condemn or exonerate the victim or the accused like a bunch of old women.

There are two lives at stake here. This is not for your personal entertainment. You ALL ought to be ashamed of yourselves.

So what else is new here? None of them has any clue about trading either... Their posts are just a pathetic extension of their trading expertise. That's a common phenomenon. Those who know don't talk, those who talk don't know...
