Kennesaw University President fired for making kneeling cheerleaders stay in the tunnel.

West Virginia State Board of Education v. Barnette, 319 U.S. 624 (1943), is a decision by the United States Supreme Court holding that the Free Speech Clause of the First Amendment protects students from being forced to salute the American flag or say the Pledge of Allegiance in public school. The Court's 6–3 decision, delivered by Justice Robert H. Jackson, is remembered for its forceful defense of free speech and constitutional rights generally as being placed "beyond the reach of majorities and officials."

So this has nothing to do with a student from being dismissed from a school team or squad. Zero.

It does if a student is dismissed for kneeling for the national anthem as you suggested

I would urge the state legislature to pass a bill stating that any student athlete or cheerleader who kneels for the national anthem will immediately be dismissed from the squad.

You can be dismissed from a team or squad for any reason. It is not a first amendment issue. It will never be successful in court as first amendment issue. In fact you cannot find a case supporting your assertions.

Because I cant find any cases of a student being dismissed for kneeling during the national anthem and losing in court. You claimed it happened with ECU and I'm still waiting for you to post your source to that.

Athletes and cheerleaders at universities are allowed to be members of their teams if they adhere to the rules and regulations of the team. If they are caught drinking, have poor grades, offend the coaches, disrupt university functions, or do anything else that displeases the university they can be kicked of the team or squad at any time. This is not about their "constitutional rights" -- they can protest anyway they want on their own time but this does not mean they will represent the university by being a member of a team or squad at public events.

Do you have the "constitutional right" in the workplace to disrespect the flag on company time in their office and expect not to get fired? The answer is no.

Let's take a look at the reality -- the suit was settled. She did not win in court. Both sides claimed victory in court. And as noted in the other thread -- she lost her other suit regarding her first amendment rights which was laughed out of court.
