C'mon now, you make it sound like Republicans would be above using it for the first time if they could get a SCOTUS in.


Well probably not......... in this environment where everything comes down to a onesided vote, but the fact of the matter is the democrats chose to open this jar, and now its about to bite them in the ass.
 
Actually, only 50 votes are required. Vice President Pence, who is the President of the Senate, would cast the tie-breaking vote. I think there is a lot of fear-mongering going on by the Democrats. We don't know how Chief Justice Roberts or Justice Gorsuch will vote on a challenge to Roe v. Wade. We also don't know how the new nominee to the court will vote. I'm sure precedence and "settled law" will be factors in the decision making process.


Pence is not the “President” of the Senate.

They dont even need 51 votes, they only need 50, the Vice president or the speaker makes the decision if its 50/50, from what ive read.

This is the ultimate burn to democrats, they decided to choose the nuclear option and now they cant do anything to stop it, the ultimate irony.

The GOP was obstructionist and filibustered every nomination. It was Reid's only hope of moving judges through the system.
