Justice Scalia warns that the Supreme Court is causing the 'destruction of our democratic system'

People don't seem to appreciate that when judges invent rights or make up law, they are arrogating to themselves rights that belong to voters. We don't have a federal judiciary to deal with difficult questions that the congress can't seem to resolve. That is judicial tyranny, not democracy, no matter how well-intentioned or "progressive" they are.

Just part of "Liberalism" in general.

Too bad everyone can't envision America back to around 1900. Any Leftism or Progressive notions were no more than a twinkle in someone's eye.

NOW look where we are!

Good point, though. That is rightism for you, organize into collectives (corporations) and wrestle the system into treating your collective as a single person (with the power of thousands). The right has always been about collectivism and destroying America.

The Constitution gets interpreted in light of public policy at the highest level. There's plenty of restraint and deference to the other branches, but from time to time history puts it in a position where it is the only solution to cut through political gridlock or effect fundamental justice.

This is exactly wrong. The Supreme Court or lower federal courts are not some body of wise men and women appointed to guide us through our policy problems or get us over the hump on divisive issues like gay marriage and abortion.

We find ourselves in a situation where a judicial tyranny has imposed policies on We The People that would never have been approved by our elected representatives. Yet people meekly accept it. After all, the Court has spoken.
