Judge Vinson Gives Obama 1 Week To Appeal ObamaCare Ruling

In a harshly worded opinion, Judge Roger Vinson, the Florida federal judge who struck down the entire health care law in January, gave the Obama administration seven days from today to appeal his ruling with the 11th Circuit Court of Appeals.

In the ruling Vinson is critical of Justice Department lawyers for waiting nearly two weeks before filing a “motion to clarify.”

He said he had expected the government lawyers to immediately seek a stay of the ruling.

“It was not expected” he wrote, “that they would effectively ignore the order and declaratory judgment for two and one-half weeks, continue to implement the Act, and only then file a belated motion to “clarify.”

Vinson acknowledged the issue will ultimately end up before the Supreme Court and he said parties should move with haste. “The sooner this issue is finally decided by the Supreme Court, “ he wrote, “the better off the entire nation will be.”

This is a political issue potentially being decided by the courts, so both sides will play politics on this equally.

Obama has already been tipped off that he will lose 5-4 in the Supreme Court.

That is why he is trying to get the states to adopt Obamacare measures independently. He knows it is unconstitutional at the federal level due to interstate commerce laws. Obama thinks Obamacare might be constitutional at the state level.

Good luck with that. 29 states are already suing. In as soon as one week the rest could summarily reject Obamacare and the whole thing could be effectively dead. Imagine that.

California will probably embrace a state version of Obamacare. Life expectancy in California could drop relative to other states. All Americans will pay for their folly.

And Romney can shove Romneycare as well. Rhinos need not apply for the Republican nomination.

Do you have a source for this information or are you speculating ?
 
I don't know how the Supreme Court works in regards to fast tracking a case,but they need to rule on this ASAP.If states and insurance companies start implementing Obamacare and the Supreme Court rules against it this country will have one hell of a mess on its hands.

He also took a little jab at Romney about Romneycare.

Doubt it. "Truth", "right", "Constitutional" mean nothing to a Leftist with an agenda.

I get the feeling that Obama's only interest in the Constitution trying to find ways to circumvent it to his advantage or viewpoint.

Liberals are already trying to pressure Thomas and Scalia to recuse themselves from the future Obamacare case because they know if Obama's appointments do so the court will certainly toss out Obamacare.

They know they have lost. All they can do now is attempt to rig the supreme court by getting 2 members to recuse. Its lowdown dirty card cheatin'.

Obamacare is dead. Stick a fork in it. This president has become a 1st term lame duck with 2 years to go.

Even his attempts to govern by decree will be slammed in court. Barrack Obama is a clear failure. This morning he is boasting that unemployment is "under 9%" as though that were some kind of real accomplishment.

He won't file an appeal because he knows what will happen.
