Seems we have no need for a president, or even a congress. Lets just let the judges make all the decisions. What could possibly go wrong with that kangaroo system?

No problem with what the judge did and I fully support seeing this case stay on track to go up to the supreme court.

The libs better hope they understand what they are cheering for here. Chances that the court is going to uphold the idea that an executive order can replace the will of congress as expressed through properly enacted and constitutional immigration law are slim to none. A lot of these little rulings have to do with whether a president can turn on or off certain programs without following very specific administrative precedures, notice, public hearings, etc. In other words, the court is not ruling that you cannot do certain things, only that you have to go back and follow the correct procedure, which can very easily be done.

The lefties better hope they get a good deal with Trump on this daca thing because if it falls apart then trump will not extend daca and even if he does the court will probably void daca so he cannot extend it even he wants to- by executive order. THEN WHAT?

At some point the Executive will have to simply disregard judicial findings that conflict with the consitutionally delineated powers of the President.

Jump has and is appointing a pile of lower level judges, plus he will get to appoint a couple more supreme court justices.

That will help.

But there is no immediate cure for the nineth circus. You just have to let em do what they gotta do and keep it moving up to the supreme court.

I am all for the rule of law. But at some point you have to wonder when the executive branch wonders if it needs to give and deference to a lower level court which is predictable hostile its actions regardless of the merits of the issue.

I would like to see the briefs but I wonder how a court can order a President to continue to carry out and ultra vires program which usurped Congress power in the first place.

I can't imagine how a court could think it has that kind of power.

At some point the Executive will have to simply disregard judicial findings that conflict with the consitutionally delineated powers of the President.
