This eviction thing is a mess. Biden got backed into a corner where he had to something even though the time to act had passed and he was/is looking like a complete idiot.
He already got the message from the Supreme Court- ie. he needed to go to Congress if he wanted to extend it. Did he do that?
The other thing that is ugly is that Biden said publicy that he did not think it was legal or constitutional to extend it based on what the court said and that his legal scholars had advised him of that. Then as the pressure set in he starts saying that most still do not think it will pass legal muster but that they are casting around to find some that say that it might.
Then he throws in the kicker that even if the court does not allow it, he still will have bought some time just because of the time that it will take to reach the court.
The court is not going to like that. Aside from the obvious which is that he did not take it to congress or did not get it passed anyway, the court does not like to be gamed where a plaintiff says that they dont really think it is legal either but they just want to game the process to buy some time.
It's lazy and sloppy and bad faith, The dems caught Joe sleeping - which is fairly easy to do- and now he knowingly skirting the law to try to recover.

He also assumes that the court will not hear it on an expedited review or issue a stay based on the fact that they have already substantially heard the case and ruled on it and issued guidance to the government. Not sure what the opponents next move is but Joe will only make things worse if he is not careful.
