Top Senate Democrat says FBI email action 'may have broken law'

Washington (AFP) - The US Senate's top Democrat blasted FBI chief James Comey Sunday for announcing a new review of Hillary Clinton's emails just days before the presidential election, an action he says "may have broken the law."

Allegations Clinton put the United States at risk by using a private email server while secretary of state were thrust back into the spotlight Friday when Comey revealed a renewed FBI probe into the matter based on a previously unknown trove of emails.

"As soon as you came into possession of the slightest innuendo related to secretary Clinton, you rushed to publicize it in the most negative light possible," Senate Minority Leader Harry Reid said in a statement.

"Through your partisan actions, you may have broken the law," Reid said, alleging that Comey had violated the Hatch Act, which bars the FBI from influencing elections.

Clinton has demanded the FBI director explain in detail why he had effectively reopened an inquiry declared complete in July, branding Comey's move "deeply troubling" so close to Election Day.

According to US media, the probe was renewed after agents seized a laptop used by Clinton's close aide, Huma Abedin, and her now estranged husband, Anthony Weiner.

The disgraced former congressman who resigned in 2011 after sending explicit online messages is under investigation over allegations he sent sexual overtures to a 15-year-old girl.

Both Clinton and her Republican rival Donald Trump have piled pressure on Comey to put his cards on the table and end speculation about the investigation before America goes to the polls on November 8.

US networks reported Sunday that the FBI had obtained a warrant to search the emails. It formerly had a warrant only to search Weiner's laptop for communication with the teenager.

According to CNN, discovery of the emails occurred weeks ago although the FBI did not reveal the matter until Friday.

While Clinton is still overwhelmingly expected to win the ballot, polls -- many of which were taken before the FBI email announcement -- showed the US election tightening Sunday.

In the same memo, Reid also struck out at the FBI chief for sitting on "explosive information about close ties and coordination between Donald Trump, his top advisors and the Russian government."

"I wrote to you months ago calling for this information to be released to the public," Reid said.

Former White House ethics lawyer Richard W. Painter contended in a New York Times opinion piece published Sunday that the FBI director broke the law with his letter to congress announcing the FBI was examining new emails related to its probe into Hillary Clinton's private email server.

Painter argued that FBI Director James Comey violated the Hatch Act, which ensures "that federal programs are administered in a nonpartisan fashion," by making "highly unusual public statements about an FBI investigation concerning a candidate in the election."

Painter said he brought those concerns to the Office of Special Counsel and the Office of Government Ethics with a a complaint against the FBI.

"The letter was sent in violation of a longstanding Justice Department policy of not discussing specifics about pending investigations with others, including members of Congress," wrote Painter.

He also referred to such a disclosure on the eve of a general election as an "abuse of power."

Painter served as an ethics lawyer for George W. Bush's administration from 2005-2007. In the piece Painter discloses that he supported GOP candidates during the primaries, but eventually pivoted to Hillary Clinton.
 
Why stop with Comey? Put them all in jail, especially Lois Learner and the head of the IRS. And of course Hillary. And just for good measure Ivanka or any spouse of a nominee who meets privately with the DOJ on a plane and talks about golf or grandchildren.
This the Clinton World. 8 years of this crap. One investigation after the other. Endless scandals.

Richard W. Painter wrote in a New York Times an op-ed:
The F.B.I.’s job is to investigate, not to influence the outcome of an election.


Such acts could also be prohibited under the Hatch Act, which bars the use of an official position to influence an election. That is why the F.B.I. presumably would keep those aspects of an investigation confidential until after the election. The usual penalty for a violation is termination of federal employment.

And that is why, on Saturday, I filed a complaint against the F.B.I. with the Office of Special Counsel, which investigates Hatch Act violations, and with the Office of Government Ethics. I have spent much of my career working on government ethics and lawyers’ ethics, including two and a half years as the chief White House ethics lawyer for President George W. Bush, and I never thought that the F.B.I. could be dragged into a political circus surrounding one of its investigations. Until this week.


This is the second complaint to be filed against FBI Director Comey. The Democratic Coalition Against Trump has also filed a complaint against Comey for interfering in a presidential election as a federal employee.
 
Is that the same Harry Reid who said he "heard" Romney didn't pay any income taxes? The same Harry Reid who became hugely rich on a senator's salary?

Is that the same Patrick Leahy who used to pompously lecture us in the Reagan and Bush days that the "appearance" of impropriety was as serious as wrongdoing? Or that the seriousness of the charges mandated investigation, regardless of the absence of any evidence? And that no administration could investigate itself?

Same guys right?
 
Wow Tony, you sure changed your tune on Comey

James Comey is the best FBI directer of our time. Although himself A Republican,he put politics aside and did what was right.

In our justice system it is common for investigators to think someone broke the law or was in a grey area of the law but decide its not a strong enough case to win and decide not to bring charges. Comey had the integrity to do what he believed was right and not what republicans wanted him to do.

James Comey is one of The FBI's best directors ever. A Republican who doesn't let politics or party affiliation influence his decisions.
