The court said that the President has immunity from his duties and then sent it back down to the circuit court to find that line between official duties and private business

Because the DOJ was so greedy to try this case they pushed it to the Supreme court to quickly before they could draw that line, now they need to do what they should have done before they sent it to the high court, send the case along with a line drawn

There is a reason we have the Legislature, Executive and Judicial branches of the government to check abuses like, in this case, a department of the Judicial branch using its power to target political opponents to destroy them. Each branch of the government, are co-equal and checks each other for abuses.
 
Along with constitutional scholar AOC, Chuck Schumer weighs in:

“This is a sad day for America and a sad day for our democracy. The very basis of our judicial system is that no one is above the law. Treason or incitement of insurrection should not be considered a core constitutional power afforded to a president,” he said.

Chucky is not one to get bogged down in little details such as the fact that - at no place and time- has Trump been charged with either treason or insurrection.

Trump should be putting together his list of his next court appointees- and not listening to the hoi polloi in the dem party. And if the dems get a clear majority after the election, Trump should offer to go forward with the dems plan to increase the number of justices on the court. :cool:

No abuse because the Supreme Court gave Trump partial immunity and then punted it back down to the lower courts.

Simply, the criminal trials will wait until after the U.S. Presidential election and the lower courts will then decide about a sitting President (Trump if he wins the 2024 U.S. Presidential Election)...which crimes by Trump are "unofficial acts" and which are "official acts". Thus, Trump could then go on trial as the first sitting U.S. President in history to be prosecuted for felony crimes while already a convicted felon.

In my opinion, it would be a bigger fall for Trump if the lower courts decide "after" in comparison to these criminal trials occurring now before the election when he's just the front-running political candidate for the U.S. Presidency.​

Therefore, most likely this issue will return to the Supreme Court to determine if Trump can Pardon himself if convicted as a sitting U.S. President. I wouldn't be surprised if we see another Nixon/Watergate situation or more accusations that the courts are after Trump even though Trump will be in charge.

If the above plays out...Trump and MAGA will fight like hell to do whatever it takes to keep Trump in the oval office including finding ways for Trump to Pardon himself before a sitting President is stuck at home under house arrest.

Next Up: July 11th Hush Money Sentencing...most likely 1 - 2 months house arrest plus required to pay for restitution/fines. Prosecution and Defense lawyers probably negotiating behind the scenes with Judge Merchan for a light sentencing.

Supreme Court may have punted this down to the lower courts to determine what's official and what is not official but it could backfire and Trump is then prosecuted as a sitting U.S. President...

This will again then be punted back up to the Supreme Court because Trump will never let the lower courts decide to prosecute him for crimes that are defined by the lower courts to be "unofficial (private) actions".

Yet, we all knew this would not go to trial before the election...too many clever delays. The Supreme Courts has too many "questions" and they want the lower courts to help them "answer" those questions.

Then, I suspect they will kick the case back to lower courts for determination on what constitutes official and unofficial acts. Depending on the lower courts decision, it may then make it back to SCOTUS for a ruling. Highly unlikely that the Jan 6 "case" will make it to trial prior to the election. If it did, it would only strengthen Trump's poll numbers further.
