Is there any question that Hillary mishandled classified information? Of course not, that's why the decision to not prosecute was based on intent, as irrelevant as that is to the case. That is why this matter is not quite put to rest.
"Intent" is always a relevant component of any criminal prosecution. Lack of criminal intent can be a reason why successful prosecution is unlikely. Prosecutors are faced with a judgement call on whether to risk wasting everyone's time on a prosecution that has little likelihood of succeeding. There are other elements of the H.Clinton email investigation beyond the lack of criminal intent that made the decision not to recommend indictment sensible. In both the Petreaus case and the case of the sailor who took unauthorized nuclear submarine photos there was also a lack of criminal intent. There were features of these latter two cases, however, that made them quite different than the Secretary Clinton case.

Why? Because the sailor chose to lie and destroy evidence after an interview? You do know other sailors took pictures and nothing happened to them while this guy was prosecuted for his actions AFTER he took those photos.

Can you cite a precedent where someone went to prison for having a private email setup while working in government especially when the person is an OCA? Should Trump be given the death sentence for intentionally giving highly classified material to his handlers in the Russian government ignoring that he is an OCA as well? Hillary was not a Original Classification Authority for Top Secret and Special Access Programs. That's an outrageous lie. Post the exact law that gives SecSTATE authority to unilaterally declassify Top Secret and SAP intelligence.

There is zero chance the Sec State has authority to release SAP and Top Secret intel. This is drone strike, CIA kill lists, US spies overseas...

She had all that on her server. That intel had to be copied by hand onto paper, or screen shotted with a phone, from the closed terminal networks in the Pentagon, and then retranscribed and sent to Hillarys home email server. Where it was copied and resent again by Hillary, in many cases.

Intent can be established by the fact she had a duty to protect the information and she received the information. Some of the laws she violated were purposefully written to not require a criminal mind set.

Prosecution of Hillary for certain crimes would have been a 100% lock save the fact she was a celebrity. There is not question she committed acts which made here guilty.

As the OCA for the entire department, it was her absolute authority to determine what's classified and what's not.
