No its not, point a gun at a policeman while they attempt to arrest you and see how much due process you get.
Thats the extreme, but shows you cant expect full due process rights while you resist arrest.
And things are bound to wrong when you resist arrest, its becomes a chaotic situation.
There's a process (with training) for that, too.
So the Constitution tells you who gets due process and who doesn't?

There is due process when you point a gun at a policeman. It is investigated and if the policeman's life was in direct threat of life or death he or she is allowed to use their weapon to defend themselves and the investigation will uphold the shooting and that is due process.
If the officer was not at risk...say from a guy on the floor handcuffed and the police officer kills him, then no due process was followed and the person goes to jail for murder only when it is videotaped so the cop cannot lie about it (like the cop who was taped shooting a man in the back running away and then wanted to plant a weapon).
The implication is if you point a gun at an officer and he hits you with his firearm, you've received due process. If you resist arrest there is another due process for you. The new tape shows even the female passenger in the car urged Floyd to "stop resisting ". If the police think you are under the influence of drugs there is another process for that. The more high you are the more risky it is. They will tend toward restraint even if you might need more flexibility. Even worse when you freak out without telling them what drug your high on.
At this point the knee on the neck is being re-evaluated and it's coming to light this is part of an approved process when the arrested is strong and high. If so, it might not be a racist situation at all. And if there is anything wrong with it then it is equally threatening to anyone of any race who is resisting due to drugs.
The cop had his knee on his neck for over 8 minutes while he was handcuffed and prone on the ground and not a threat to anyone, especially the cop.

The new footage, and more information about police training will blow your ethno identity racist politics to pieces. In my opinion the knee was not necessary and is a threat to every race that is stupid enough to be so damned high they can't resist resisting arrest. My solution would allow the suspected stupid idiot to stand, sit or lie down, so long as both hands and feet are cuffed and there are enough officers around to protect themselves from accomplices with guns...until an EMT has arrived. Then another process for that. Then another process for charges.
