The parties mostly responsible for these events are the troops who committed the (alleged) killings.
During peace time, individual soldiers commit murder, rape, etc. Is it the brigade commander's fault if one of his soldiers murders a civilian? Unless the brigade commander ordered that soldier to kill the civilian, the answer is no.
If a disturbed employee of Merck poisons medication, and patients die, is the CEO of Merck responsible? No, he is not.
Until our military is populated by robots, there will always be crimes committed by soldiers, who are human beings.

Briones' mother, Susie Briones, told CNN her son is now suffering from post-traumatic stress.
