I am saying and the Court saying that if something is not specifally enumerated then the burden is on the party to demonstrate that it is a logical and legal extesnion of other provisions in the Constitution. I will say aqain- this will be the fourth time- but you are slow here- that Marbury was able to accomplish that but that Roe was not. Just because Marbury was successful, does not make the Roe argument successful. Can I get a friggin DUH on that.?
I even quoted for you the area where Alito said he went on at length about how - since it was enumerated- he was looking for citations as to which other parts of the constitution they were relyng upon- AND HE /the majority on the court FOUND NONE. Alito and the conservatives argued that Roe was poorly reasoned and poorly decided, AND, the inconvenient truth is that Ruth Ginsberg said the same. But Roe works for you and women over on the View where you get all your legal training so I guess that is special too.
Look Cowboy. Bad week for you at the court. The gun and abortion cases made you a complete loser. But rest up a little and next week you will be back at it - arguing that inflation is transitory and that having four million invaders a year crossing into the country is good for the economy and society. It's what you do. Keep doing it all the way up to the election. That's fine. Not a problem.
And yes, the Solicitor General argued that if Roe falls then all sorts of other goofy, unconstitutional, poorly-decided cases could be at risk. Especially if Republicans win in 2024. And you should be worried about that. But hey, if gay marriage or transgender shit cases are challenged you can always argue that Marbury won. That's a winner. OR NOT.
I just wish that Scalia had lived to see Roe overturned but Alito and Thomas and the new ones did a fine job of staying the course. Well done Brett. Well done Clarence. Well done Amy. Roberts, you are a dipshit as always.
The US Supreme Court and Republican majorities in the House and Senate is the only wall we have left to protect the US from the total destruction from within by Joe Biden and the most extreme liberal, Anti-American traitors in Congress. We also, have the deep state hard at work with them. We have over 2 1/2 years left of the Joe Biden and extreme liberal radical agendas to fight and defeat.
Nothing is goofy here except the Alito opinion which allows other privacy issues to stand but not abortion. If you’re looking for a scam, there’s your scam. And Alito is a bad faith actor, I’m sure he looked in his text messages for Ginni’s opinion but not beyond that. And of course the opinion is flawed. No matter what you say Alito et al admit this flaw which of course undermines the whole house of cards all the way down to Thomas’s own marriage. But yeah keep ignoring that like these right wing justices aren’t picking and choosing which laws fall under their “not enumerated” scam you keep trying hock.
Anyway, you are correct, more shit going to roll out of SCOTUS and the institution is now regarded worse than Congress and the president.
