Court says Dennis Perry can't sue Kraft Heinz over 'Mayochup,' Reuters says 17:36 KHC The 5th U.S. Circuit Court of Appeals determined that a man who created a blend of ketchup and mayonnaise he referred to as "Metchup" is not able to sue Kraft Heinz for selling a similar product known as "Mayochup," but ordered reconsideration of whether to cancel the main's trademark registration, Reuters' Jonathan Stempel reports. The court said there was little chance people would confuse Mayochup with Metchup, which is sold in the lobby of Dennis Perry's nine-room Star Motel in Louisiana, Stempel notes. The three-judge court, however, said that the company had not met its "heavy burden" to prove that Perry abandoned his Metchup trademark, citing the man's testimony that he hoped to improve the condiment's packaging and sell millions of bottles, the author notes.
