PENN was rising Thursday after a top shareholder said it wants seats on the board of the casino operator and online-betting company.
Shares of Penn jumped 5% to $26.27.
In a 13D securities filing Thursday, hedge fund HG Vora Capital Management—which owns an 18.5% position that includes Penn’s common stock and swaps—wrote that the shares were “significantly undervalued,” adding that it has discussed “a range of topics focused on enhancing shareholder value” with the company’s management and board.
“Given the persistent underperformance of the Common Stock and the Issuer’s capital allocation track record, amongst other areas of concern, the Reporting Persons have requested that the Issuer afford them the right to designate highly qualified directors who would be committed to working with the Issuer’s management and fellow Board members to help the Issuer realize its full potential,” the filing read.
