Correct. And such evidence is on the record.

Flynn's chances however are remote but not unprecedented. Not because his motion is without basis but that he is so deep into the process. His action, however, does serve to notify others who are subject to legal action from Mueller that he is up to his old tricks of withholding exculpatory evidence- an area that caused Mueller many, many reversals on appeal. Even if it cannot be reversed, his attorneys are nevertheless savvy enough to know that it factors into the judges thinking at the time of sentencing.
