I'll be honest, I purged most decent points you made as I kept reading the proceeding terrible points in that giant paragraph, so my bad.

Thing is though, as long as there's a profit motive, and these industries can lobby laws into and out of existence, you'll always have them pushing for mass incarceration; innocents and petty criminals be damned.

Why? Is he a flight risk? Has a public defender so he's obviously not able to hire and retain top shelf legal representation. According to the leftist lawyers in the video this man is having his rights under the 14th amendment violated. Let him out O.R., put an ankle bracelet on him an hope he shows up for his court date. This is how the radical left would have the justice system working if they had their way.

80+% of bracelet catch and releases come back to their court date (in DC), higher than the national average, where bail may be the norm.
 
there are of course two sides of the argument. I did not see the whole video I tried to skip to the argument.
the argument I saw was slated...

1. if poor people are given the same bail amounts as wealthy people you are not treating them differently.

what the argument is, is there is a disparate impact.


2. So the proper analysis involves weighing disparate impact vs the fact that people in prison will generally be less able to put on as good of a defense as people outside of a prison.

If people are a risk of flight but you can cut back on their risk by having them mortgage a family home... I think you should consider letting that person out of jail for many if not most crimes so they have a a chance to put on their best defense.

4. In short... the issue is really keeping someone in jail until they are proven guilty.

Bail is a compromise... and I think it can be a good one.

So maybe they should be getting liberals to put up bail money in an non profit manner.
