Fed Judge - Obama amnesty unconstitutional

If this was a federal district court judge's decision, it would only be binding in his district. Even if it was appealed to a Circuit Cocurt of Appeals, their decision is only binding in their circuit.

Obama will probably just ignore it. And I hope the judge has a good tax accountant.
 
yes... but victory below may bode well for split circuits after other cases gets heard. therefore the sup ct can take it up.

I don't think the court would uphold the idea that non signed executive orders granting all sorts of rights on non citizens is an appropriate action for an executive to do under our constitution. Its not in the prosecutorial discretion category... its much more.
 
Allowing them to get green cards, etc goes way beyond any notions of prosecutorial discretion. If Obama wants to tell ICE to look the other way, as though that wasn't already their policy, it's maybe one thing. Legalizing people who under the law are clearly illegal is way beyond that, as the judge pointed out.

It won't matter though if a democrat judge gets the case. Liberals have totally politicized the federal judiciary, so that cases are decided on tribal grounds. Belong to the right group and you win, forget the law.
