Are you sure about this Tao. I thought the only things off limits were religion, race, sex and age. And I'm not sure religion and age are always off limits. Firing someone who is too sick to do their job isn't any different than firing someone who can't do their job, I think that's the way it is in Texas. But I don't know for a fact what the laws are on this.

I'm positive. You can't fire someone who is too sick, they go on disability and keep coverage (until they've exhausted their lifetime limit of benefits, of course - then they're eligible for medicaid I think). You certainly cannot fire them because they are sick, however.

As far as religion and age, they are completely off limits. Someone over 40 is considered a "protective class." So is a muslim, etc. This doesn't mean they can't be fired via other means, but you have to document a good deal about why their performance is bad, how many times you've brought it up, etc. Otherwise you open yourself up to lawsuits - and the employee almost always wins the lawsuit (because the judge/jurors always sympathize against the big, bad, evil corporation).

A lot of general commentary here, but nothing substantial to back up your post. Would you care to look up labor law with me? It's a fact, Ricter, and any HR group worth it's salt will be able to tell you about it. Firing an employee because of cancer will open the company up to a lawsuit.
 
On the fire department past a certain age you can't get hired (I think it's 35) and past a certain age you are forced to retire. Not quite the same thing but close.
