As of now he is not facing charges for that.The grand jury hearing is for filing a false police report.
 
Considering Fox is already rewriting the script and cutting his roles entirely out, they probably, got the goods on Justin Smollet already. They fear the negative backlash is going to hurt them and cutting him loose while, they can! And when you have even Avenatti saying this was a hoax, you know how bad it really is! They might just be giving Justin Smollet more rope to hang himself with! If reports are true that they have convened a grand jury, the offense must be serious enough to warrant it! I will laughing my head off when this guy gets charged and locked up! Well deserved Justin Smollet! You got it coming!

Actually the TMZ reported over the recent hours that the grand jury may not convened today for the Smollett case because the local police and Feds desire to upgrade the charges. This likely means the grand jury session for Smollett will be held next week based on the allotted time slots. There are also additional tipsters that police want to interview including a car sharing service driver and and individual who stated all three were in an elevator together.

The case and the charges against Smollett will be much broader than "filing a false police report".
