Some slippery testimony going on in that Hur hearing.
Hur repeats over and over that he did not prosecute Biden because whether or not you can get a conviction is an element of every prosecutor's assessment.
Yeh, okay. Within reason. If you have marginal facts but he has solid facts.
The reality is that he knows he cannot get a conviction on a democrat in DC or Biden's home state of Delaware.
Otherwise, if Hur put those same facts before a jury, with the same cognitive status as Biden BUT the defendant was a republican then we are talking an easy conviction- very easy. He knows it and we all know it.

The AG gets to decide- often it is a little of each ie. both doj and civilian in background. They are often DOJ types who have retired or no longer with the department so they are technically civilian but their DNA is DOJ. Retired judges are used often as well. The AG can also appoint a current employee and give them special counsel status, as I think is the case of Hur. Sometimes the special prosecutor retains their district attorney appointment for their prosecutorial district but agrees to serve as special prosecutor for a specific case elsewhere. For example when the u.s. district attorney for- Alabama I think- also served as special counsel to look into the Clinton Foundation.
Some things are actually a little hazy too. For years, the special counsel act was followed but that Act recently expired so I think the AG just uses their generic power to appoint special counsel and whatever steps make sense to them. And of course, congress can appoint too. Same scenario with them too. The special counsel act used to be the guide but that has expired. It's like that. But some of it is a little hazy these days.
