Does IB take responsibility? An amazing story

To IB: You have made a couple requests to handle this in private, but have not followed through.

...I don't believe there is anything else I can add to clarify (although I will be happy to do so, if I missed something). Optiontrader, I don't think this is the proper forum for discussing the details of your particular problem...

...If you think (and from the contents of this thread it seems that you do) that IB harmed you or did not live up to its agreement with you, there are proper ways to deal with that. I don't believe what you are doing in this thread qualifies as such.

Errors in the automatic liquidation algorithm are possible. We are fixing these problems ASAP. I know several cases when bugs caused bad liquidations and customers received a full compensation or we rebuilt their account, which was expensive sometimes. That happens VERY rarely. Generally, it is your responsibility to not allow any liquidation to start.
Till now, you have done a good job talking around the point; when will the questions I posed on page 18 be reckoned with? You've made a cruel decision which we view as not understandable, so we want an explanation to be assured you are relating to the points being raised. I don't care which forum--but the silence is very unprofessional.

Have you looked at suing them ? I don't know about the US, but here in the UK I'm sure you'd have a legal angle. Might be worth a consultation....

if you post in a public forum you need to provide proof of your statements.

show proof that IB wants to handle your requests in private.

That is starting to become a consideration. Regarding the US, we already consulted with an attorney. He was very definite that IB is at fault.

Why don't you or your "securities lawyer" cite the law, regulation or NASD provision that states that when a broker has a right to liquidate it mus tbe done in a manner to not harm the client unnecessarily.
This is an email quote from my securities attorney:
...NASD Rule 2110 requires "a member, in the course of his business, shall observe high standards of commercial honor and just and equitable principles of trade." Implicit in this is the requirement that a broker's legitimate actions not harm a customer any more than is absolutely necessary.

This is all interesting, but I've got to wonder, didn't your lawyer tell you to stop posting? Your continued posts show your hand, risk libel claims, and put you in a public relations fight with a company that has tens of millions to spend on it.

Whether or not you're right has really nothing to do with it--you've made your point. Either sue, or move on.

Thank you for concern about a fellow human being.
Everything was done under legal consultation and therefore the right care was used. Yes, there's enough people out there who say a lot of things about all different companies who I question whether or not they know guidelines--find a hot issue, and Google it; you will see what I mean.

Option_Trader: It seems to me that your posts at this point are only aimed at keeping the thread alive.
I have suggested to you that if you have a complain, there are legitimate ways for you to contact IB about it. You may or may not have done that - I don't know. One thing I do know though, that posting here will not get you a resolution.

Moderator: please consider closing the thread. Thank you.
